Many analysts said it is unrealistic to think one piece of legislation alone could satisfy Biden’s climate goals. At the same time, it leaves the very real question of how the United States will close the gap.

Executive actions are subject to court challenge and are easily reversed by future presidents. State climate action is largely limited to Democratic states, though there are exceptions like North Carolina. Even congressional spending could be rolled back by future Republican majorities. €œGiven that we may see a change of majority next year, all the rulemakings, all the legislation, it is all vulnerable in the long run,” said Michael Mehling, a professor at the Massachusetts Institute of Technology.

The advantage of the clean energy spending approach is that it would drive more deployment of new emissions-cutting technology, he said. That, in turn, would drive a reduction in costs. €œTechnological progress you can’t vote out of office,” Mehling said. If countries fulfill their updated climate pledges, the planet would be on track for 2.2 degrees of warming—or more than the 1.5- to 2-degree target agreed to under the Paris Agreement. €œEmissions Gap Report.” Yet climate risks remain. Seemingly slight increases in temperature can have drastic consequences, she noted. Coral reefs, for instance, disappear in a world where temperatures rise 2 degrees. €œThat is the story of working on climate change,” Fransen said.

The amphibians often lay their gelatinous eggs in pools of water to provide the moisture needed to develop properly—but those pools can dry up. €œThe biggest cause of [frog] offspring mortality is desiccation,” says University of Newcastle ecologist John Gould. When studying frogs in Australia's Watagan Mountains, Gould was surprised to find evaporated puddles where eggs thrived for days, swaddled in nests their mothers whip up by aerating mucus secretions with their toes.

€œYou could see embryos still alive and kicking,” he says. Scientists had previously hypothesized that several frog and toad species use foam to protect eggs from desiccation, but few studies had tested the idea. So Gould and his colleagues monitored 641 mucus nests built by the sandpaper frog, Lechriodus fletcheri, to determine whether embryos were surviving dry mountain conditions. They also conducted the first laboratory experiments to closely follow eggs' development in nests deprived of water.

The team found that the embryos could indeed successfully develop in a dried-up pool if the eggs encasing them were protected by slimy frog foam. In some nests stranded on dry land, embryos even endured well after full development, until a pool was replenished by rain—and a few successfully hatched into tadpoles. €œThe froth nest acts almost like a life-support system that sustains the viability of the eggs,” Gould says. He also found that larger nests provided more protection, and eggs closer to the core could survive longer.

The new work is detailed in Ichthyology &. Herpetology. Elisa Barreto Pereira, an ecologist at Brazil's Federal University of Goiás who was not involved in the study, says froth nests could be crucial to helping frogs survive as the climate changes. €œThe foam nest is an important adaptation,” she says—one that evolved several times in different frog groups and continents when Earth's average temperature peaked about 55 million years ago.Nearly a year after the first anti inflammatory drugs treatments became available for adults in the U.S., the moment millions of parents have been waiting for has arrived.

The U.S. Food and Drug Administration has authorized the Pfizer-BioNTech mRNA treatment against anti inflammatory drugs for use in children ages 5–11. An FDA advisory committee voted nearly unanimously Tuesday to recommend authorizing the treatment for young kids, which the FDA did today. Next week, a Centers for Disease Control and Prevention advisory group will meet to review the data and will likely recommend the treatment for all children ages five to 11.

Nathali Rodriguez, a mother of two in Grand Prairie, Texas, says she is calling her children’s pediatrician this week to try to schedule their treatment for the first day it is available. €œI want to get them a treatment as soon as possible,” Rodriguez says. €œI feel like we’re at that light at the end of the tunnel. Just knowing that they’ll be vaccinated makes me breathe a little bit easier, and with the holidays coming up, we’ll feel a lot safer being all close together.” The treatment has been “tested meticulously in children according to the FDA’s guidelines” and found to be safe while generating a very good immune response, according to Kawsar Talaat, an epidemiologist at the Johns Hopkins Bloomberg School of Public Health and a principal investigator of the Pfizer-BioNTech treatment trials in children aged six months to 11 years.

It is especially important to vaccinate kids right now that they are back in school, and given the higher disease rates seen with the Delta variant surge, which has resulted in more pediatric hospitalizations and deaths, Talaat says. More than 1.1 million U.S. Children were infected with anti inflammatory drugs in September alone, and 41 died, Talaat notes, citing data from the CDC reported by NBC News. Although severe disease is unusual in this age group, “a small minority of 1.1 million is a lot of kids ending up in the hospital,” Talaat says, and 41 deaths is “a lot of kids dying from a disease that hopefully will be completely treatment preventable within the next few weeks.” Early in the symbicort, anti inflammatory drugs appeared mild enough in children, and their viral transmission rates low enough, that vaccination was not a priority for this age group—but that was before Delta.

Paul Offit, an infectious disease pediatrician and director of the treatment Education Center at Children’s Hospital of Philadelphia, notes that children accounted for only 3 percent of cases at the start of the symbicort, but now account for closer to 27 percent. €œI think you can reasonably consider this to be a disease of children, and therefore children need to be protected,” says Offit, who serves on the FDA’s treatments and Related Biological Products Advisory Committee, which reviewed the Pfizer data. anti inflammatory drugs is much more serious than a respiratory disease like influenza, he adds. €œWhat this symbicort does that’s unique [among] all respiratory symbicortes is it causes you to make an immune response to your own blood vessels.

I haven’t seen anything like that before,” Offit says. About one in 3,000 children with confirmed anti-inflammatories s, including those that are mild or asymptomatic, develop multisystem inflammatory syndrome (MIS-C)—a condition that can involve the lungs, heart, kidneys, liver and other organs—about four to six weeks later. €œI don’t know of any respiratory symbicort that does that,” Offit says. According to the data provided by Pfizer to the FDA’s advisory committee, the treatment trial included 1,518 children who received the treatment and 750 who received a placebo.

The treatment was 90.7 percent effective in preventing symptomatic anti inflammatory drugs disease, based on 16 s in the placebo group and three s—all very mild—in the vaccinated group. s in the placebo group were more severe. Most of the s occurred in August and September, when Delta was the dominant variant. The trial did not measure the effectiveness in preventing asymptomatic s.

The data also showed that children ages five to 11 responded to a lower 10 microgram (mcg) dose just as well as people ages 16 to 25 responded to the 30 mcg adult dose. In fact, the average antibody levels in children with the lower dose were a smidgeon higher than that seen in the teens and young adults (albeit by less than 5 percent). €œThere are three [anti inflammatory drugs-related] diseases that have now become treatment-preventable in children. [acute anti inflammatory drugs respiratory disease, MIS-C and long anti inflammatory drugs],” says Sallie Permar, chair of pediatrics at Weill Cornell Medicine and New York-Presbyterian Komansky Children’s Hospital.

Permar also noted the importance of the treatment even for children who have already had a anti inflammatory drugs . €œFor whatever reason, natural immunity is not as good at protecting individuals in the long term against severe disease,” Permar says. €œEven where a child has been infected, they still may not have that full protection against severe disease that we know the treatment can provide.” Fewer Side Effects The study data revealed that the treatment’s side effects in children under 12 were similar to what was seen in adolescents but milder, closer to what was seen in adults older than 55. Fever, chills, headache and fatigue were all less common in kids than in teens and young adults, and the former experienced less joint pain than older adults.

After the first dose, one in three kids felt tired, and one in five had a headache. After the second dose, rates of fatigue (39 percent) and headache (28 percent) were slightly higher than after the first dose, but the only side effect reported more often by younger children than by teens and older adults was redness and swelling at the injection site, which occurred in 10 to 20 percent of children who received the treatment. About three quarters of children in the trial reported having pain at the injection site. No serious or severe side effects related to the treatment occurred, and there were no severe allergic reactions.

There were also no cases of myocarditis or pericarditis, inflammation of the heart muscle or lining around the heart that have occurred rarely after vaccination in adolescents and young adults, primarily in males. Although Pfizer has received some criticism for running a trial with too few participants to detect myocarditis cases, “no trial could be large enough to detect the extremely rare side effects known to be associated with the treatment,” Permar says. In the group with the highest risk, boys aged 16 to 17, the risk of myocarditis after vaccination is approximately one in 5,000. €œBut there’s good reason to anticipate those possible side effects will be even rarer in younger children because the dose was designed specifically for their age group,” Permar says.

Each dose, given three weeks apart, is 10 mcg instead of the 30-mcg dose authorized for teens and adults. In its review of the Pfizer data, the FDA advisory committee determined that the treatment would prevent enough severe anti inflammatory drugs cases to outweigh potential risks of treatment-related myocarditis, even if myocarditis rates from the treatment are similar in children ages five to 11 as they are in older kids. That is unlikely, and not only because of the lower dose, Talaat says. €œMyocarditis has a higher frequency in adolescents and young adult males, independent of any treatment,” Talaat says.

€œThey just seem to be at higher risk for it, and that same risk doesn’t exist in children ages five to 11. So just naturally, independent of the treatment, the rates of myocarditis should be lower.” For parents still concerned about myocarditis, Offit notes that cardiac problems occur with MIS-C (a complication of anti inflammatory drugs) as well, and at higher rates than that from the treatment. €œThere are no risk-free choices,” he says. €œThere are just choices to take different risks.

If you vaccinate, you may have a very rare risk of having myocarditis from this treatment,” but published evidence to date suggests it is temporary and lacks any long-term effects, he says. Multiple Benefits to Vaccination The biggest benefit to vaccinating children is preventing them from getting sick. But vaccinating kids also reduces gaps in immunity across the population, which in turn lowers the likelihood of new viral variants developing, Permar says. “We will do be doing our part to provide the population immunity that will decrease symbicort spread and thereby prevent the next dominant variant,” she says.

€œChildren are part of the [symbicort’s] transmission chain. They still spread the symbicort, including in households, so you’re protecting those who do not respond well to treatments and have immune-compromising conditions by vaccinating your child.” The treatment authorization’s timing is also ideal before winter family gatherings increase the likelihood of transmission. €œGetting your treatment [now] will ensure that there may be a second dose administered before the holidays when you’re getting together with your extended family,” Permar says. In fact, for millions of families, the most meaningful benefit of the treatment is regaining the freedom their children lost to the symbicort more than a year and a half ago.

For Rodriguez, whose husband has a high-risk medical condition, the treatment means their family can attend church again—they stopped attending when the congregation stopped masking—and her five-year-old son can play soccer after nearly two years of begging to play. €œJust knowing that there’s a treatment now, we can maybe get a little bit back to normal and let them be a little bit more free. It just gives me a little bit of hope that I don't have to worry as much anymore.” In rural Alaska, the treatment means an end to extreme isolation for the young children of Elizabeth W., mother who asked to withhold her last name because she has family and friends who oppose vaccination. Her 10-year-old son takes immunosuppressants for Crohn’s disease, and her six-year-old daughter has hemophilia and is therefore at higher risk for severe anti inflammatory drugs if she gets infected.

Both children have been so isolated from others that her son has begged her to “pretend” he’s 12 and get him the treatment early. Now that he and his sister can be vaccinated, they can resume attending church and visiting family in other parts of the state. Elizabeth Harman, a philosophy professor at Princeton University in New Jersey, says her 11-year-old daughter is excited to play basketball this winter after missing last season. She and her five-year-old sister participated in the Pfizer pediatric trial but did not know if they received the treatment or the placebo.

Pfizer will be “unblinding” participants now that the FDA has issued the EUA. The girls joined the trial partly in the hope of getting vaccinated “sooner rather than later, to keep them safe and also keep us safe,” Harman says, but they also wanted to contribute to ending the symbicort. €œGetting vaccinated is a way that each of us can help to end the symbicort,” Harman says. €œWhen your kids get vaccinated, they are doing a concrete thing to help end the symbicort, and it’s a wonderful thing you can do for other people.”House Oversight and Reform Chair Carolyn Maloney said yesterday that she intends to subpoena four major oil companies and two trade organizations for documents and communications as part of her committee’s investigation into climate misinformation.

The subpoenas, expected to be formally issued in the coming days, would be a major step, extending the reach of a congressional probe of the fossil fuel industry that could last well into next year. €œI see no choice but to continue our committee’s investigation until we see the truth,” Maloney (D-N.Y.) said at the end of a high-profile hearing with Big Oil executives and trade groups. Democrats had requested a massive trove of internal documents from Exxon Mobil Corp., BP America Inc., Shell Oil Co., Chevron Corp., the American Petroleum Institute and the U.S. Chamber of Commerce, whose top executives appeared before the committee virtually and offered hours of testimony yesterday.

The committee initially requested documents by Sept. 30 (Greenwire, Sept. 16). When the companies did not fully comply, Maloney said, they were warned that the panel would take further action if they did not produce sufficient paper ahead of yesterday’s hearing.

€œUnfortunately, none of the six entities can produce the substantial portion of the key documents the committee requested,” Maloney said. €œInstead, they produced reams of other documents, many of which were publicly available.” The companies, Maloney said, offered up thousands of pages—but not the kind of behind-closed-doors information about climate science and misinformation funding that Democrats had been looking for. €œOne entity sent in 1,500 pages printed from their own website, available publicly, along with 4,000 pages of newsletters filled with industry press releases,” Maloney said. €œOthers sent us thousands of pages of publicly available annual reports and the companies’ postings on Facebook and LinkedIn.” The companies, generally, have pushed back against the idea that they are not giving lawmakers sufficient information, and during the hearing, they denied any role in promoting misinformation about climate change.

Committee ranking member James Comer (R-Ky.) defended the companies and objected to Maloney’s subpoena announcement, noting that they have produced more than 100,000 documents and calling it “an infringement upon their First Amendment rights.” “This is the Oversight and Government Reform Committee,” Comer said, referring to the panel’s formal name when Republicans controlled the House. €œWe’re supposed to focus on waste, fraud and abuse in the federal bureaucracy.” “Well, I disagree,” Maloney responded as she banged the gavel to end the hearing. €˜They are obviously lying’ Democrats had billed the hearing as a reckoning for Big Oil on par with the 1994 congressional hearing with the top figures in major tobacco companies, when executives falsely claimed that nicotine is not addictive. Perhaps the most tense exchange in the six-hour hearing came when Maloney suggested that Exxon CEO Darren Woods was lying under oath (Greenwire, Oct. 28). Maloney asked the Exxon chief about a 1997 speech by former Exxon CEO Lee Raymond raising concerns about the Kyoto Protocol. Raymond claimed that "the case for so-called global warming is far from airtight." Exxon’s own scientists had told company leadership some two decades earlier that “there is general scientific agreement that the most likely manner in which mankind is influencing the global climate is through carbon dioxide released from the burning of fossil fuels." But Woods said Raymond’s claim was "aligned with the consensus of the scientific community" at the time and that the company’s views have “evolved and developed" with the science.

"I was hoping that you would not be like the tobacco industry was and lie about this. And I was hoping that you would be better than the tobacco industry and that you would have come out with the truth," Maloney responded. "I’m disappointed with the statement that you made." Shortly after that exchange, Maloney played a portion of the sting video released by Greenpeace UK over the summer of former Exxon lobbyist Keith McCoy saying that the company had supported and spread climate misinformation (Climatewire, July 1). €œMr.

Woods called Mr. McCoy’s comments ‘inaccurate,’ and then they fired him,” Maloney said. €œAnd they are obviously lying like the tobacco executives were.” Maloney doubled down after the hearing. €œYes,” she told reporters when asked whether Woods had lied during their exchange.

€œI think that the document speaks for itself. They want to act like that was long ago. But then we had the report from their lobbyists recently that we played, where they admitted they were spreading disinformation.” It’s an accusation with serious implications. When tobacco executives falsely claimed that nicotine is not addictive during the 1994 hearing, the Department of Justice launched a criminal perjury investigation, though the charge was ultimately dropped.

Asked whether Woods or any of the other executives had perjured themselves, Maloney said, “Everything is on the table,” and noted that it would be a matter for law enforcement. Next steps Executives spent much of the hearing defending themselves, and they got a hand from Republicans, who sought to blame Democrats for high gas prices and turn the hearing into a discussion about inflation and the negative effects of climate change policy. Several Republicans directly thanked the companies and encouraged them to increase production, despite claiming to care about climate change, which is caused by fossil fuel emissions. Rep.

Byron Donalds (R-Fla.) at one point called Democrats’ questioning “disgusting” and suggested that Attorney General Merrick Garland investigate them for witness intimidation. €œTrying to get you to pledge on what you’re going to spend your money on is a gross violation of the First Amendment,” Donalds said. The companies and trade groups, meanwhile, highlighted support for carbon pricing and the Paris Agreement. €œWe also recognize that society must continue to diversify our energy mix to address climate change,” Woods said.

€œExxon Mobil has long recognized that climate change is real and poses serious risk, but there are not easy answers.” BP America CEO David Lawler acknowledged skepticism of his company’s net-zero pledge and its promise to slash oil and gas production by 2030. €œI get it,” Lawler said. €œOur progress hasn’t always been a straight line, but we’ve learned a great deal, and we view the path we’re on as a business imperative.” It might not be the last word from the oil executives in front of Congress. Maloney said she would consider hauling them in again if the need should arise, and Rep.

Ro Khanna (D-Calif.)—the chair of the Environment Subcommittee, who has led much of the investigation—suggested the probe could go on well into next year. Khanna said he also wants to bring in executives from social media companies and public relations firms that have cast doubt on climate science. Despite their insistence that they support policies to reduce emissions, Khanna noted that none of the four oil companies distanced themselves from the American Petroleum Institute’s lobbying against methane reduction policies when given a chance during the hearing. €œI thought it was such a telling moment that you had blatant examples of third-party groups engaging in lobbying that was against the companies’ professed values and statements,” Khanna told reporters.

Yesterday, an FDA advisory committee reviewed data from a clinical trial testing a low-dose version of the treatment made by Pfizer and BioNTech on children in that age group—and voted nearly unanimously to recommend that the FDA grant the shot emergency approval.

Anticipating that the FDA and the US Centers for Disease Control and Prevention (CDC) will soon give the treatment the thumbs up, and that distribution to children will begin in the coming weeks, infectious-disease researchers are now looking ahead to how immunizing 5- to 11-year-olds—the largest group of people in the United States not yet eligible for the treatment—will change the course of the symbicort. €œIt will save lives in that age group,” says Emma McBryde, an infectious-diseases modeller at the Australian Institute of Tropical Health and Medicine in Townsville. But it could also have a broader impact, given that many US children aged 5 to 11 have returned to school unvaccinated in the past few months, and the group now accounts for a significant portion of new anti inflammatory drugs cases, capable of transmitting the anti-inflammatories anti-inflammatories to others. €œFor every child’s life you save, you may well save many, many more adult lives,” she says.

The benefits outweigh the risks The FDA advisory panel voted in favour of approval on 26 October, on the basis of clinical-trial data showing that the Pfizer–BioNTech treatment is about 91% effective at preventing symptomatic anti-inflammatories in 5- to 11-year olds. Around 4,650 children participated in the trial. Nearly two-thirds received treatment doses that were one-third that of an adult jab (the others received a placebo). In a procedure similar to that used to vaccinate adults with the messenger RNA jab in the United States, kids received two doses, three weeks apart.

For the children tested, the data show that the treatment is safe. MRNA-based treatments have been linked to a very small risk of myocarditis, an inflammation of the heart muscle, and pericarditis, an inflammation of the lining around the heart, particularly in young men. But there were no reports of either condition in the 5- to 11-year olds involved in the trial, which is a very encouraging sign, says Andrew Pavia, chief of the division of paediatric infectious diseases at University of Utah Health in Salt Lake City. If the shot were distributed to a larger population, however, regulators would need to watch for any sign of the side effects, Pavia notes.

Before the advisory panel’s meeting, an independent FDA review of Pfizer’s data evaluated six fictional US scenarios, with varying levels of symbicort in the community, and found that, for the most part, the benefits of the treatment “clearly outweigh the risks”. Officials determined that even if symbicort levels were very low across the country, the overall benefits of the treatment would probably still outweigh the potential risks of heart problems, because these conditions typically resolve in a few days after vaccination, unlike anti inflammatory drugs, which can cause death. Mina Fazel, a child and adolescent psychiatrist at the University of Oxford, UK, and her colleagues surveyed nearly 28,000 pupils aged 9 to 18 at 180 UK schools and found that the younger children were more undecided than their older counterparts. The survey also suggested that social media plays a part. Pupils who spent more than 4 hours a day on social platforms were less willing to receive the treatment than were those who spent less time on social media.

€œWe have a generation of young people before us who are engaging with information and learning at an unparalleled scale,” Fazel says, adding that it is more important than ever to tailor public-health campaigns for kids. Global implications What the authorization of a treatment for US children aged 5–11 might mean globally also remains to be seen. Almost 70 countries have fully vaccinated less than one-fifth of their populations and will probably not vaccinate younger children for months, or even years, to come. But some countries, including Israel, are waiting to see the US regulators' decision before approving their own jabs.

Other countries, however, are already vaccinating children under age 12. For instance, Chile, China, Cuba and the United Arab Emirates have begun inoculating kids with various anti inflammatory drugs treatments in the past three months. In places where the population has a very low natural immunity to the symbicort because community transmission has remained low throughout the symbicort, McBryde says, childhood vaccination will be essential. How should I take Symbicort?

The actions brought the total number of enforcements carried out under the agency's HIPAA Right of Access Initiative to 25.

"Timely access to your health records is a powerful tool in staying healthy, patient privacy and it is your right under law," said OCR Director Lisa J. Pino in a statement.WHY IT MATTERS As the press release notes, the Right of Access Initiative is intended to support individuals' ability to get their health records in a timely fashion at a reasonable cost, as HIPAA requires. Without an extension, a HIPAA-regulated entity must provide an individual or a representative with their records 30 days after receiving a request. In one of the most recent enforcement actions, the Ohio-based Advanced Spine and Pain Management was accused of waiting nearly four months to send a patient a copy of their protected health information. The provider was fined $32,150.

In another action, the Rainrock Treatment Center, located in Eugene, Oregon, paid OCR $160,000 after a patient said it had sent their records on May 22, 2020 – almost eight months following the initial request. In a third, Dr. Robert Glaser was fined $100,000 after failing to provide a patient with his medical records after several years. Glaser, a solo practitioner in New York State, also did not cooperate with the agency's investigation or respond to OCR's data requests. Glaser also waived the right to a hearing.

The fourth and fifth enforcement actions also involved delays in releasing medical records to patients. Denver Retina Center paid $32,150 to settle a potential HIPAA violation, and Wake Health Medical Group paid $10,000. THE LARGER TREND OCR has been carrying out right of access enforcement actions since 2019, when it fined a Florida hospital $85,000 for failing to give a pregnant person access to their medical records. Although the presidential administration – and head of OCR – has changed, the agency shows no signs of slowing. In 2021, it's pursued roughly a dozen cases.

Still, patients are sometimes driven to bring their own legal actions. The actions brought the total number of enforcements carried out under the agency's HIPAA Right of Access Initiative to 25.

"Timely access to your health records is a powerful tool in staying healthy, patient privacy and it is your right under law," said OCR Director Lisa J. Pino in a statement.WHY IT MATTERS As the press release notes, the Right of Access Initiative is intended to support individuals' ability to get their health records in a timely fashion at a reasonable cost, as HIPAA requires. Without an extension, a HIPAA-regulated entity must provide an individual or a representative with their records 30 days after receiving a request. In one of the most recent enforcement actions, the Ohio-based Advanced Spine and Pain Management was accused of waiting nearly four months to send a patient a copy of their protected health information. The provider was fined $32,150.

In another action, the Rainrock Treatment Center, located in Eugene, Oregon, paid OCR $160,000 after a patient said it had sent their records on May 22, 2020 – almost eight months following the initial request. In a third, Dr. Robert Glaser was fined $100,000 after failing to provide a patient with his medical records after several years. Glaser, a solo practitioner in New York State, also did not cooperate with the agency's investigation or respond to OCR's data requests. Glaser also waived the right to a hearing.

The fourth and fifth enforcement actions also involved delays in releasing medical records to patients. Denver Retina Center paid $32,150 to settle a potential HIPAA violation, and Wake Health Medical Group paid $10,000. THE LARGER TREND OCR has been carrying out right of access enforcement actions since 2019, when it fined a Florida hospital $85,000 for failing to give a pregnant person access to their medical records. Although the presidential administration – and head of OCR – has changed, the agency shows no signs of slowing. In 2021, it's pursued roughly a dozen cases.

Still, patients are sometimes driven to bring their own legal actions.
